Presentation Description: With more and more European developers entering the U.S.'s growing renewable energy industry, questions often arise not only on the development requirements for projects in the US, but also on how the various European Union (EU) regulations may come into play. Directive 2011/92/EU is an EU law that requires major building or development projects in the EU to be assessed for their impact on the environment before the project can start. Similarly, Regulation EU 2018/1999 requires member states to track and report their implementation progress, with the first reports required to be submitted in March 2023. These directives are similar to the U.S.'s NEPA regulations, which are triggered by federal actions, and not simply development alone. It is important to note the comparison between the various EU regulations and development guidelines in the United States is complex and nuanced. The differences between the two systems are influenced by a variety of factors, including legal frameworks, political contexts, and cultural values. This presentation intends to explore the various components of the common EU regulations, how they compare to NEPA (and other traditional due diligence studies in the US), and under what scenarios these regulations may be required for projects on U.S. soil.
