Ben Cowan chairs the renewable energy practice at Locke Lord LLP, leading a team of nearly 20 attorneys nationwide handling a wide range of project development, M&A and financing issues and transactions. Ben has a broad-based environmental law practice, but for the past 19 years has focused on wildlife and natural resource issues for renewable energy developers and investors. He advises his renewable energy clients on complex permitting matters under federal and state wildlife statutes such as the Endangered Species Act (ESA), Bald and Golden Eagle Protection Act (BGEPA) and Migratory Bird Treaty Act (MBTA), as well on other environmental liability concerns in connection with project development, financing and operational issues. He was a member of the wind industry's WEBAT negotiating team that worked with the USFWS for over 8 years to develop many of the policies that are now commonly applied in permitting take of listed bats, and is particularly focused on finding solutions to the challenging issues presented by the gap between statutory requirements, agency policy and market realities.
